Terms of Service

Last updated: July 2, 2026. By using Boatable, you agree to these terms.

1. Platform Role and Scope

Boatable is a technology platform that connects boat owners with marine service providers, enables community-sourced boating intelligence (condition reports, fuel prices, trip logging), and provides AI-assisted vessel research. Boatable is not a marine service provider, contractor, employer, or insurer.

Boatable coordinates — it does not perform marine services, guarantee provider availability, or assume liability for work performed by independent service providers. All service relationships are directly between the boat owner and the provider.

2. Acceptance of Terms

By accessing or using Boatable, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you must not use the platform.

You must be at least 18 years old to create an account or use Boatable's services.

3. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Boatable of any unauthorized use of your account.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

4. Marine Safety Disclaimer

BOATABLE DATA IS FOR INFORMATIONAL PURPOSES ONLY. It is not a substitute for official nautical charts, U.S. Coast Guard Notices to Mariners, NOAA weather advisories, or professional marine surveys.

Crowdsourced condition reports, fuel prices, ramp statuses, and hazard reports are submitted by community members and have not been independently verified by Boatable. Always exercise caution and use your own judgment on the water.

Boatable is NOT FOR NAVIGATION. Do not rely on Boatable data for route planning, depth determination, or navigational decisions. Use certified navigational tools and charts for all vessel operations.

In an emergency, contact the U.S. Coast Guard on VHF Channel 16 or call 911. Boatable is not an emergency service.

5. Service Marketplace Terms

Service providers on Boatable are independent contractors, not employees or agents of Boatable. Boatable does not guarantee the quality, safety, legality, or timeliness of any services performed.

Boatable may facilitate the exchange of service requests, quotes, and communications between owners and providers. Boatable does not guarantee that a provider will be available, that a quote will be competitive, or that work will be completed to satisfaction.

Geographic coverage and provider availability are expanding. Service timelines and provider matching may vary by region.

6. Deposits, Payments, and Refunds

Payments processed through Boatable use Stripe as the payment processor. A platform transaction fee applies to completed service jobs. The current fee schedule is available on the Pricing page.

Deposits: When a service provider requests a deposit before beginning work, the deposit is held by Stripe on behalf of the provider. Boatable does not hold funds directly.

Refunds: If a service job is cancelled before work begins, any deposit paid will be refunded in full. If work has begun and a dispute arises, Boatable will facilitate communication between the parties but cannot unilaterally issue refunds for work partially completed.

Disputes: If you believe a charge is unauthorized or services were not delivered as described, contact Boatable support within 30 days. Boatable will investigate and facilitate resolution between the parties. If resolution cannot be reached, either party may pursue mediation or arbitration as described in Section 12.

7. AI and Copilot Services

Boatable's AI Copilot provides AI-generated research, diagnostics guidance, and service recommendations. Copilot responses may contain errors and are not a substitute for professional marine advice.

All Copilot service recommendations are subject to human review by qualified marine professionals before any work is performed. Do not rely solely on AI-generated content for safety-critical decisions.

AI-generated content may reference third-party sources. Boatable does not guarantee the accuracy or timeliness of cited sources.

8. User-Generated Content

By submitting content to Boatable (condition reports, reviews, posts, photos, trip data, community contributions), you grant Boatable a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and improving the platform.

You retain ownership of your original content. You represent that you have the right to submit content and that it does not violate any third party's rights.

Boatable may remove content that violates community standards, contains false information, or is otherwise objectionable at our sole discretion.

Boatable respects the intellectual property rights of others. If you believe content on Boatable infringes your copyright, please see our DMCA Policy at /dmca for instructions on filing a takedown notice.

9. GPS, Location, and Vessel Data

Boatable may collect GPS coordinates and location data when you use trip recording, condition reporting, or map features. Location tracking is opt-in and can be disabled at any time.

GPS tracks from trips are downsampled to approximately 111-meter precision for public sharing to protect your privacy. Full-precision data is only visible to you.

Vessel data you provide (make, model, year, engine) is used to power fitment-based service matching, fleet analytics, and community intelligence features. You own your vessel data and may export or delete it at any time.

10. Provider Insurance and Licensing

Service providers are responsible for maintaining appropriate insurance, licenses, and certifications required by their jurisdiction. Boatable does not verify, guarantee, or insure any provider's credentials.

Transport carriers must maintain DOT/MC authority and appropriate cargo insurance as required by federal and state law. Boatable does not verify carrier compliance.

Boat owners should verify a provider's credentials independently before authorizing work on their vessel.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOATABLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.

Boatable's total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to Boatable in the 12 months preceding the claim, or $100, whichever is greater.

This limitation applies to all causes of action, whether based on warranty, contract, tort, or any other legal theory, and whether or not Boatable has been advised of the possibility of such damages.

NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by applicable law. If you are a consumer in a jurisdiction where these limitations are prohibited, certain of the above limitations may not apply to you.

12. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or your use of Boatable shall first be submitted to non-binding mediation. If mediation is unsuccessful within 60 days, either party may submit the dispute to binding arbitration administered by the American Arbitration Association ("AAA") under the AAA Consumer Arbitration Rules then in effect. The arbitration shall be conducted in the English language in Hennepin County, Minnesota, or at another mutually agreed location.

Fee Allocation: For claims where the amount in controversy is $10,000 or less, Boatable will pay all AAA filing, administration, and arbitrator fees. For claims exceeding $10,000, filing and administration fees shall be allocated in accordance with the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys' fees unless the arbitrator determines that a claim was frivolous, in which case the arbitrator may award reasonable attorneys' fees to the prevailing party.

Small Claims Court: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes and claims within the jurisdiction of that court, provided the claim is not aggregated with claims of other persons.

30-Day Opt-Out: You may opt out of the arbitration and class action waiver provisions of this Section 12 by sending written notice to legal@boatable.app within 30 days of your first acceptance of these Terms. Your notice must include your name, email address associated with your Boatable account, and a clear statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms remain in effect, and any disputes will be resolved in the state or federal courts of Hennepin County, Minnesota.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL.

13. Account Termination

You may delete your account at any time through the Settings page. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Aggregated, anonymized data derived from your contributions may be retained.

Boatable may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or pose a safety risk to the community.

14. Modifications to Terms

Boatable may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.

15. Indemnification

You agree to indemnify, defend, and hold harmless Boatable, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual property rights; (d) any content you submit or transmit through the platform; or (e) your interactions with service providers, including disputes over service quality, timeliness, or payment.

This indemnification obligation will survive the termination of your account and these Terms.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with the Privacy Policy and any other policies or notices published on the platform, constitute the entire agreement between you and Boatable regarding your use of the platform. These Terms supersede all prior and contemporaneous agreements, proposals, negotiations, representations, and communications, whether oral or written, between you and Boatable relating to the subject matter herein.

18. Waiver

The failure of Boatable to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Boatable. No waiver shall be deemed a further or continuing waiver of such term or any other term.

19. Assignment

You may not assign or transfer these Terms, or any rights or obligations under these Terms, without the prior written consent of Boatable. Boatable may freely assign or transfer these Terms, in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets. Any attempted assignment in violation of this section shall be void.

20. Survival

The following sections shall survive the termination or expiration of these Terms: Section 4 (Marine Safety Disclaimer), Section 8 (User-Generated Content), Section 11 (Limitation of Liability), Section 12 (Dispute Resolution and Governing Law), Section 15 (Indemnification), and any other provisions that by their nature should survive termination, including payment obligations, warranty disclaimers, and limitations of liability.

21. Force Majeure

Neither Boatable nor you shall be liable for any failure or delay in performing obligations under these Terms where such failure or delay results from events beyond the reasonable control of the affected party, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government actions or orders, war, terrorism, riots, civil unrest, labor disputes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.

The affected party shall use commercially reasonable efforts to mitigate the impact of such events and resume performance as soon as reasonably practicable. If a force majeure event continues for more than 90 consecutive days, either party may terminate the affected obligations by providing written notice to the other party.
